Ankored Sensitive Data Acknowledgment and Consent for Data Subjects

By submitting data to Ankored, you acknowledge and agree that:

1. Data Subject. You represent and warrant that you are acting on your own behalf or acting as an authorized legal representative on behalf of another individual (including as the legal guardian acting on behalf of a minor). The individual whose data is collected under this Ankored Sensitive Data Acknowledgement and Consent Form ("Consent Form") is herein referred to as "You." For purposes of this Consent Form, a "Minor" means any individual under the age of eighteen (18).

2. Data Collection. Ankored, Inc., together with its subsidiaries, affiliates, assignees ("Ankored") will collect, capture, receive, or otherwise acquire Your facial image, driver's license number, passport number, other government identification data or copies of such documents (collectively, "Sensitive Information"), medical history, vaccination history, concussion history reports, or other doctor or medical information or records or copies of such reports (collectively, "Health Information"), or any combination of the above (collectively, "Your Data").

3. Permitted Purpose. Ankored may collect, use, disclose, and otherwise process Your Sensitive Information as necessary to verify Your identity ("Permitted Purpose"). In furtherance of the Permitted Purpose, Ankored may also disclose Sensitive Information to certain third parties to support identity verification as consistent with the Ankored Privacy Policy (available at ankored.com/privacy-policy) or in accordance with Ankored's Terms of Service or agreements you enter into with third parties through Ankored's platform.

4. Retention and Deletion. Subject to Section 7 below regarding Minors’ Data, Ankored may retain Your Data as long as is necessary or relevant for the Permitted Purpose, consistent with applicable law.

5. Withdrawal. You may withdraw Your consent at any time by contacting Ankored as set forth in the Ankored Privacy Policy. If You choose to withdraw Your consent, Ankored may be unable to verify Your identity and provide further services.

6. Artificial Intelligence. Ankored uses artificial intelligence ("AI Technology") to assist in document authentication and data extraction for identity verification purposes. "AI Technology" refers to machine learning, deep learning, and other artificial intelligence technologies, including statistical learning algorithms, models (including large language models), neural networks, and other artificial intelligence tools or methodologies, all software implementations of any of the foregoing, and related hardware or equipment. For data subjects who are not Minors, and subject to the consent provisions of Section 9 below, you consent to Ankored’s processing and use of Your anonymized data derived from the information provided by You, which may include personal data (as defined under applicable law), Your Health Information, and metadata from documents containing Your Sensitive Information, to develop, train, and use Ankored AI Technologies, develop additional Ankored products and services, and to fulfill other lawful purposes consistent with the Ankored Privacy Policy.

7. Special Provisions for Minors’ Data. Notwithstanding any other provision of this Consent Form, when processing documents or data pertaining to Minors (including but not limited to birth certificates, identity documents, and age verification materials, collectively, “Minors’ Data”), Ankored applies the following enhanced protections:

(a) Limited Use. AI Technology is used solely for document authentication (verifying that documents appear legitimate and unaltered) and extraction of specific data fields necessary for verification (such as name and date of birth). Minors’ Data is not used to train, develop, or improve AI models, algorithms, or any other AI Technology.

(b) Permanent Deletion. Subject to Section 7(c) below, Minors’ Data are permanently and irreversibly deleted from Ankored's systems immediately upon completion of the verification decision (whether approved or rejected). This deletion is a hard deletion, not a soft deletion or archival.

(c) Human Review Exception. In limited circumstances where Minors’ Data requires manual human review (for example, where AI Technology cannot extract required information from a particular document), such Minors’ Data may be retained for a brief period not to exceed seven (7) calendar days solely to enable quality assurance review of the verification process. During this period, such Minors’ Data are used only for internal process improvement analysis and are not used for AI model training. Upon completion of such review or expiration of the seven (7) day period, whichever occurs first, the documents are permanently deleted.

(d) Third-Party AI Providers. When Minor's data is processed using third-party AI services, Ankored ensures such providers operate under zero data retention policies, meaning no Minors’ Data is stored, retained, or used by such third parties for any purpose beyond the immediate processing request (including training).

 

8. Falsification of Records, Violation of Law. You understand that falsifying government documents is a violation of federal law, specifically under the provisions of U.S. Code Title 28, Part V, Chapter 115, Section 1746, which governs unsworn declarations made under penalty of perjury, and U.S. Code Title 18, Part 1, Chapter 47, Section 1028, which prohibits the creation, use, or transfer of fraudulent identification documents or authentication features. You acknowledge that any actions involving the falsification or misrepresentation of such documents can result in severe legal penalties, including fines and imprisonment. You represent and warrant that You will ensure the accuracy and authenticity of any documents submitted, and You are aware that falsification is subject to criminal prosecution under federal law. You represent and warrant that you have all necessary rights, titles, and legal authority to provide Ankored with Your Data as set forth herein and the consent in Section 9 below.

9. Consent. You consent to Ankored's collection, use, processing, and storage of Your Data for the Permitted Purpose and as otherwise set forth in this Consent Form and any other purposes to which you consent while using Ankored's services or platform in accordance with Ankored's Terms of Service or the agreement between you and any third party providing services through Ankored's platform.

10. Acknowledgement. You have read and agree to this Consent Form and to the use of Your data and Minors’ Data (if any) consistent with this document and Ankored's Privacy Policy (available at ankored.com/privacy-policy).

11. Severability. Should any provision of this Consent Form be held illegal, invalid or unenforceable by any governmental body or court of competent jurisdiction, such holding shall not diminish the validity or enforceability of any other provision of this Consent Form.

By submitting Your Data to Ankored, you are agreeing to this Consent Form and consenting to the collection, processing, storage, and disclosure of Your Data in accordance with the terms set out above.
